In no event shall The Pole Edit's total aggregate liability exceed one hundred dollars ($100).

Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved by binding arbitration under the rules of the American Arbitration Association governing consumer disputes. By agreeing to these Terms, you and The Pole Edit each waive the right to a jury trial and to participate in a class action. Arbitration hearings will take place in the same county and state as your billing address. Your filing fee will be capped at the amount set by the American Arbitration Association. This arbitration provision survives termination of these Terms.


Class Action Waiver

You and The Pole Edit agree that each party may only bring claims against the other in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding.


Termination

We reserve the right to terminate your access to our Services at any time, for any reason, without notice or liability.


Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California, U.S.A. Any litigation arising from these Terms shall be brought exclusively in state or federal courts located in Las Vegas, Nevada, and both parties waive any objections based on venue or forum non conveniens.

Notices from you to The Pole Edit must be sent in writing to info@thepoleedit.com. Notices from us to you may be sent via email, postal mail, or through our Services. Electronic communications satisfy any legal requirement that communications be in writing.

These Terms constitute the entire agreement between you and The Pole Edit regarding your use of our Services and may not be assigned or transferred by you without our prior written consent.
